Welcome to Roadhog Auto. The terms “we,” “us,” and “our” refer to Roadhog Auto.

Roadhog Auto operates this website and online store, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”).

Roadhog Auto is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when accessing or using our Services.

By accessing, browsing, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms, you should not use the Services.

Nothing in these Terms is intended to limit any rights or remedies available to you under applicable Canadian federal or provincial consumer protection laws.

Section 1 — Access and Account

By using the Services, you represent that you are at least the age of majority in your province or territory of residence or that you are using the Services with the permission of a parent or legal guardian where permitted by law.

You agree that the information you provide is accurate, current, and complete.

Furthermore, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

You may not transfer, sell, assign, or license your account to another person.

Roadhog Auto makes reasonable efforts to provide accurate product descriptions, images, specifications, compatibility information, pricing, and availability.

Product information may originate from manufacturers, distributors, catalog providers, or other authorized data sources.

Colors, finishes, dimensions, packaging, or other product characteristics may differ slightly from images displayed on your device.

Manufacturers may also change specifications, packaging, designs, or components without notice.

We reserve the right to correct inaccurate product information and to update, modify, or discontinue products at any time.

Section 3 — Vehicle Fitment

Many products sold by Roadhog Auto are vehicle-specific.

Customers are responsible for providing accurate vehicle information, including applicable year, make, model, trim, engine, drivetrain, cab configuration, bed length, and other relevant options.

Fitment information provided by Roadhog Auto is intended to assist customers but may rely on manufacturer or third-party catalog data.

If you are uncertain whether a product fits your vehicle, please contact us before placing your order.

Products that have been installed, modified, drilled, cut, painted, programmed, or otherwise altered may not be returnable except where required by law or where applicable warranty rights apply.

Our Refund & Returns Policy contains additional information regarding incorrect fitment and product returns.

Section 4 — Orders

Submitting an order constitutes an offer to purchase products from Roadhog Auto.

We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including because of product availability, pricing or catalog errors, suspected fraud, payment issues, shipping restrictions, or other circumstances affecting fulfillment.

An order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfillment.

If we cancel or materially change an order, we will make reasonable efforts to contact you using the information provided during checkout.

Please review your order carefully before submitting it because orders may be transmitted quickly to our distributors or fulfillment partners.

Returns and refunds are governed by our Refund & Returns Policy.

Section 5 — Prices, Taxes and Billing

Prices, discounts, promotions, and product availability may change without notice.

The price charged for a product will generally be the price displayed at the time the order is placed, subject to correction of obvious pricing or system errors.

Unless otherwise stated, displayed product prices do not include applicable taxes or shipping charges.

Applicable Canadian sales taxes and shipping charges will be calculated or displayed during checkout where applicable.

You agree to provide accurate and complete payment and billing information and represent that you are authorized to use the payment method submitted with your order.

Section 6 — Shipping and Delivery

Roadhog Auto ships products through Canadian distributors, fulfillment partners, and carriers.

Estimated delivery times are estimates and are not guaranteed.

Delays may occur because of product availability, supplier processing, carrier disruptions, weather, statutory holidays, rural or remote delivery requirements, or other circumstances outside our reasonable control.

Some products may require oversized, heavy-item, LTL, remote-area, or other specialized freight services.

Shipping destinations, estimated delivery times, rates, special-freight conditions, and territorial shipping limitations are described in our Shipping Policy.

Section 7 — Intellectual Property

The Services, including Roadhog Auto branding, logos, text, website design, graphics, and original content, are owned by Roadhog Auto or used under applicable licences and are protected by Canadian and other applicable intellectual property laws.

Product names, manufacturer logos, trademarks, product photographs, and other third-party materials remain the property of their respective owners.

You may use the Services for personal and lawful purposes only.

Except where permitted by law, you may not reproduce, distribute, modify, publicly display, publish, sell, or commercially exploit Roadhog Auto content without prior written permission.

Nothing in these Terms grants you ownership or licence rights in Roadhog Auto or third-party trademarks except as expressly permitted.

Section 8 — Third-Party Tools and Services

The Services may provide access to features, applications, payment services, product data, vehicle fitment tools, or other services operated by third parties.

We do not control all aspects of these third-party services.

Your use of third-party services may also be governed by the terms and privacy practices of the applicable third party.

We may add, remove, or modify third-party features or integrations from time to time.

Section 9 — Third-Party Links

The Services may contain links to websites or resources operated by third parties.

Roadhog Auto does not control those websites and is not responsible for their content, availability, privacy practices, or accuracy.

You should review the applicable terms and policies before conducting transactions with a third party.

Section 10 — Relationship With Shopify

Roadhog Auto is powered by Shopify, which enables us to provide the Services to you.

However, purchases made from the Roadhog Auto store are transactions between you and Roadhog Auto.

Shopify is not the seller of Roadhog Auto products and is not responsible for fulfillment, product fitment, returns, warranties, or customer service relating to purchases made from Roadhog Auto.

Section 11 — Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify may also collect and process personal information in connection with your use of the Services.

Information may also be shared with service providers, payment processors, distributors, carriers, and other partners where necessary to operate the store, process transactions, fulfill orders, provide customer service, prevent fraud, or comply with legal requirements.

Section 12 — Feedback and Reviews

If you submit reviews, photographs, comments, suggestions, feedback, or other content to Roadhog Auto, you confirm that you have the right to provide that content.

You grant Roadhog Auto a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, distribute, and adapt that content for purposes related to operating and promoting our business and Services, subject to applicable law.

You may not submit content that infringes another person's intellectual property, privacy, or other legal rights or that contains unlawful, deceptive, defamatory, abusive, obscene, or malicious material.

We reserve the right to remove content that violates these Terms or applicable law.

Section 13 — Errors, Inaccuracies and Omissions

Occasionally, the Services may contain typographical errors, inaccurate information, or omissions relating to product descriptions, specifications, fitment, pricing, promotions, shipping costs, delivery estimates, inventory, or availability.

We reserve the right to correct such information and, where reasonably necessary, modify or cancel affected orders.

If an order is cancelled after payment because of an error or unavailable product, the applicable amount will be refunded.

Section 14 — Prohibited Uses

You may use the Services only for lawful purposes.

You must not use the Services to violate applicable laws, infringe intellectual property rights, transmit malware or malicious code, engage in fraud or deceptive activity, impersonate another person, interfere with the security or operation of the Services, collect personal information unlawfully, send unauthorized spam or solicitations, bypass security measures, or otherwise use the Services in a manner that could harm Roadhog Auto, Shopify, our customers, or other parties.

We reserve the right to restrict or terminate access to the Services where we reasonably believe these Terms have been violated.

Automated systems, bots, crawlers, agents, or similar technologies must comply with applicable laws, technical restrictions, access controls, and any instructions provided through the Services.

Automated systems must not attempt to bypass security controls, access restrictions, CAPTCHAs, rate limits, or other measures intended to protect the Services.

We may restrict or block automated access where reasonably necessary to protect the Services, customers, or our systems.

We may suspend or terminate access to the Services where reasonably necessary because of a violation of these Terms, suspected fraudulent activity, misuse of the Services, security concerns, or other lawful reasons.

Termination does not affect obligations or liabilities that arose before termination.

Provisions that are intended by their nature to continue after termination will remain in effect.

Section 17 — Disclaimer of Warranties

To the extent permitted by applicable law, the Services are provided on an “as available” basis.

We do not guarantee that the website will always operate without interruption, delay, error, or security issue.

Product warranties, where applicable, may be provided by the product manufacturer and may be subject to separate manufacturer terms.

Nothing in this section excludes or limits warranties, guarantees, conditions, rights, or remedies that cannot lawfully be excluded under applicable Canadian consumer protection law.

Section 18 — Limitation of Liability

To the fullest extent permitted by applicable law, Roadhog Auto will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or any mandatory rights available to consumers under applicable law.

Section 19 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Roadhog Auto and its officers, employees, contractors, service providers, and affiliates from third-party claims, losses, liabilities, and reasonable legal costs arising directly from your unlawful use of the Services, your material violation of these Terms, or your infringement of another party's rights.

Section 20 — Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

Section 21 — Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with the policies referenced in them, constitute the agreement governing your use of the Services.

Section 22 — Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Roadhog Auto may assign or transfer its rights and obligations where permitted by applicable law, including in connection with a business restructuring, sale, or transfer.

These Terms of Service and any separate agreements through which Roadhog Auto provides the Services are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, subject to any mandatory consumer protection laws that apply in the customer's province or territory.

We may update these Terms occasionally to reflect changes to our business, services, legal obligations, or operating practices.

The most current version will be posted on this page.

Where required by applicable law, we will provide appropriate notice of material changes.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those changes, subject to applicable law.
